Terms of Service

The agreement for using Nakodo. We've kept it as plain as we can. The short version: use Nakodo for genuine, one-to-one business outreach, treat creators' contact details with care, and check what the software tells you before you rely on it.

1.About these terms

Nakodo is run by Daniel Pertu, a sole trader. In these terms, “we” and “us” means Daniel Pertu trading as Nakodo. “You” means the person who creates the account and the business they act for.

These terms are the agreement between you and us for using Nakodo. You accept them when you tick the box at sign-up, and by using Nakodo. If you don't agree with them, don't use Nakodo.

Our privacy notice explains how we handle personal data, including the creator data described below.

2.Who can use Nakodo

  • Nakodo is for business use. By using it you confirm you are acting for a business, including as a freelancer or sole trader, and not as a consumer.
  • You must be 18 or over, and able to agree to these terms for the business you act for.
  • Give us accurate details and keep them up to date.
  • An account is for one person. Keep your password to yourself; you are responsible for what happens under your account. Tell us straight away if you think someone else has used it.

3.What Nakodo does

Nakodo reads the website you give us and writes a brief. It then searches YouTube, scores the creators it finds for fit, collects the contact details creators have published, and drafts first messages for you to send.

  • Only give us a website you own or have permission to use for this.
  • We don't send messages for you. You send them yourself, from your own email or account, and you decide what to send.
  • Fit scores, briefs, summaries and drafts are written by software, partly by AI. They are estimates and can be wrong. Check them before you rely on them.
  • We can't promise that creators will reply, agree to work with you, or perform as you hope, or that any contact details are still correct.

4.YouTube

Nakodo uses YouTube API Services to find creators and read public channel information. By using Nakodo you agree to be bound by the YouTube Terms of Service. Google's handling of data is covered by the Google Privacy Policy.

YouTube's rules mean we refresh or delete YouTube data within 30 days. Creators can therefore disappear from your results, and figures can change. YouTube also limits how many searches can run each day, so new results can take time to arrive.

5.Contacting creators

The creators in Nakodo are people. These rules protect them, and they protect Nakodo's access to YouTube. They are the most important part of these terms.

When you contact a creator you find through Nakodo, you must:

  • write to them one to one, about a business collaboration that is relevant to their channel;
  • say who you are and which business you represent;
  • stop contacting anyone who asks you to, and not contact them again through other channels;
  • follow the laws that apply to you and to them, such as data protection and anti-spam laws (for example UK and EU GDPR, PECR, CAN-SPAM and CASL).

You must not:

  • send bulk or automated messages, or add creators to a mailing list or newsletter;
  • sell, share or publish creators' contact details, or move them into another database or tool to use outside these rules;
  • contact creators about anything unlawful, misleading or harmful, or harass or pressure them;
  • use what you find to profile, track or identify people other than for a business collaboration.

When you unlock a creator's contact details, you decide how they are used, so you are responsible for that use under data protection law, as a controller in your own right.

6.Using the service fairly

You must not:

  • copy, scrape or download Nakodo's data in bulk, or access it by automated means other than the exports we provide;
  • resell or share access to Nakodo, or use it to build a competing product;
  • try to get around plan limits, break or probe our security, or reverse engineer the service, except where the law allows it;
  • upload anything unlawful, or anything you don't have the right to use;
  • use Nakodo in a way that breaks YouTube's terms or puts our access to YouTube at risk.

7.Plans and payment

The Free plan costs nothing. Paid plans add more campaigns, contact unlocks, drafts and research runs. The current plans and prices are on the pricing page.

  • Monthly allowances reset at the start of each billing month. Unused allowances don't carry over.
  • An unlock or a draft counts towards your allowance when it is made, even if you later delete it.
  • If you move to a smaller plan, campaigns over the new limit are paused, not deleted.

Paid plans are billed monthly in advance, from the day you subscribe, and renew each month until you cancel. Payments are taken by Stripe, our payment provider. Prices are shown in your local currency where we offer it and in US dollars otherwise, and they include any VAT or sales tax: you pay the price shown. A subscription stays in the currency it started in. If you are in the European Union, Link, Stripe's reseller service, may sell you the subscription instead. It then charges the VAT and sends your receipts, and Checkout says so before you pay.

  • An upgrade starts straight away. You pay the difference for the rest of the current month at once, then the new price from your next billing date.
  • A move to a smaller plan, or a cancellation, takes effect at the end of the month you have paid for. You keep your current plan until then.
  • If a payment fails, Stripe retries it over the following days and your plan stays active. If it still can't be collected, your account has Free limits until it is paid.
  • We don't refund part months, unless the law requires it. Deleting your account cancels a paid plan straight away, without a refund for the rest of the month.

You can change or cancel your plan any time in Settings. We will give you at least 30 days' notice of a price change, and you can cancel before it applies.

8.Your content

You own what you put into Nakodo: your website text, notes, briefs, outreach settings and messages. You give us permission to use it only to run Nakodo for you, which includes sending it to the service providers listed in the privacy notice.

The briefs and drafts we write for you are yours to use, edit and send.

9.Our service

Nakodo, including its software, design, scoring and brand, belongs to us. While you have an account, we give you a personal, non-transferable right to use it under these terms. If you send us feedback or ideas, we can use them without owing you anything.

10.Availability and changes

We work to keep Nakodo running and your data safe, but we can't promise it will always be available or free of errors. We may change, add or remove features. If a change takes away something important on a plan you pay for, we will tell you in advance and you can cancel.

11.Ending your account

You can delete your account at any time from Settings. It takes effect straight away.

We may suspend or close your account if you break these terms, especially the rules on contacting creators, or if your use puts Nakodo, other users or our access to YouTube at risk. Where we can, we will tell you why first and give you a chance to put it right. If we close Nakodo altogether, we will give you at least 30 days' notice.

When an account is closed, we delete its data as the privacy notice describes. Download anything you want to keep first, from Settings.

12.Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Otherwise:

  • Nakodo is provided as it is and as available, without promises beyond those in these terms.
  • We are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect loss.
  • We are not responsible for what creators do or say, or for how you use the contact details and drafts you get from us.
  • Our total liability to you in any 12 months is limited to the greater of what you paid us in the 12 months before the claim and £100.

13.Your responsibility to us

If someone makes a claim against us because of how you contacted creators or used Nakodo in breach of these terms or the law, you will cover our reasonable costs and losses from that claim.

14.Changes to these terms

We may update these terms. For a change that matters, we will email you at least 30 days before it applies. If you keep using Nakodo after that, the new terms apply; if you don't agree, you can delete your account before then. The date at the top shows when they last changed.

15.General

  • These terms are the whole agreement between you and us about using Nakodo.
  • You can't transfer your account or these terms to anyone else. We may transfer them to whoever takes over Nakodo, and will tell you if we do; your rights under these terms stay the same.
  • If a court finds part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a term straight away, we can still enforce it later.
  • Nobody else has rights under these terms.
  • These terms are governed by the law of England and Wales, and its courts deal with any dispute.
